Dear Sir,

Re: Sarah Branson and Geraint Davies

You are of course aware of the injunction made by the High Court on 10th May 2005 which prohibited you, among other things from:

  • publishing to any other person any false, abusive, offensive or defamatory statements concerning the Claimants whether by means of the Internet or otherwise howsoever;
  • registering or otherwise creating any Internet domain name or web site title or meta-tag which includes the names of the Claimants or otherwise refers to or identifies them;
  • creating or publish on the Internet any direct link to material on any web site which is registered to the Defendant or over which the Defendant has control where such material relates to the Claimants;
  • publishing confidential information concerning the Claimants including their home addresses and other private contact details.
  • continuing to publish on any web site, the domain name of which is registered to him or over which he has control, any statement which asserts or suggests that the Claimants:
    • have acted unethically or dishonestly;
    • have committed any offence;
    • have conducted an affair or have or have had a sexual relationship;
    • are not competent in the exercise of their professions.

You will also be aware that the court found you in breach of this order on 28th July 2005 and sentenced you to six weeks imprisonment for contempt of court. You will also be aware from the order and approved note of judgement served on you whilst in custody that it was the intention of the Judge that you be psychiatrically examined whilst in prison, to assure the Judge that you were not suffering from any mental disorder.

We understand from Rochdale Social Services that you were assessed by the Mental Health nurse whilst in HMP Forest Bank. We also understand that this examination did not raise concerns about your mental health, and evidently did not lead to any action being taken under the Mental Health Act.

Accordingly, we must conclude from this that you understand the nature of the order made, understand the implications should you break it, and wilfully continue to do so. Your web sites www.sarahbranson.com, www.sarahbranson.info, www.tom-moore.co.uk continue to breach the order of 10th May 2005 and we must insist that these web sites are taken out of action immediately.

Should you continue to act in violation of the order dated 10th May 2005, we will be left with no choice but to issue fresh proceedings for your committal to prison for contempt of court. If you were found again to be in breach of the order, the court is likely to sentence you to a longer term of imprisonment for a second breach.

We have written to you twice previously to outline how you can obtain legal advice. We would reiterate the contents of our previous letters to you and encourage you to consult the community legal service handbook in your local library or go to http:///www.clsdirect.org.uk in order to identify a local solicitor who specialises in this field. Our client does not, nor has ever, blocked you from having legal services nor has any power to do so.

We should also draw to your attention the requirement that you pay our client's costs in the sum of £1,817. We have received none of these costs from you and ask that you make full and final payment forthwith to avoid further action in this regard.

Finally, if you do not remove this offensive material within 14 days, we will be issuing proceedings for your further committal to prison.
