FIRST WITNESS STATEMENT OF THE GERAINT DAVIES,
SECOND CLAIMANT



I GERAINT DAVIES of 3 Mulgrave Road, Croydon MAKE THIS WITNESS STATEMENT the contents of which are true to the best of my knowledge and belief. I make this statement knowing that it will be placed before the Court as evidence.
  1. I am the Member of Parliament for Croydon Central.

  2. I have read the first claimant's written statement and agree with all that she says.

  3. Mr Moore had an appointment at my surgery on 30 June 2000. The objective of the meeting was for me to try to get him to engage with social services in order to support him to provide him with housing in the knowledge that he had been reluctant to engage with social services himself.

Mr Moore was known to be a man with mental health problems who was potentially dangerous and therefore I was advised to have a plain-clothes policeman on hand and a social worker who I could invite to participate in the meeting. The social worker was sitting with me in the meeting when Mr Moore came in.

After a preliminary discussion Mr Moore noticed a piece of paper on the table - an email from Sarah Branson which confirmed that at this meeting I would be joined by a social worker and a plain-clothes policeman.

He grabbed the piece of paper and started to shout and got up from his seat at which point the plain-clothes policeman appeared behind me. Mr Moore then left the room with the piece of paper which has since been posted at the top of his website.

  1. My home address is not something that is in the public domain. MPs are encouraged to put their constituency office or Labour Party office address in the public domain instead for the personal safety of themselves and their families from harassment or criminal or terrorist acts. I am concerned that the only way the respondent was able to obtain my address was by following me from my surgery. It only came to the attention on 7 February 2005 that the respondent is impersonating myself in chat rooms. Prior to that date I had only been aware of him impersonating the first claimant.

  2. I, like the first claimant, am deeply concerned about the offensive material the Respondent is posting in my name. I see attached to the first claimant's witness statement in both of our names they have my home address below the signature where I live with my wife and three small children. I am obviously concerned, as is the first claimant, that someone who is offended by these posts (or some religious, racial or other group) may attempt to physically seek me out and harm me or my family.

  1. I am applying for this order on a without notice basis because of the urgency of this situation and because if the respondent has notice of this application before I have the protection of the Court, I am certain that he will merely use the information contained in it to harass me further by posting it on the World Wide Web.

  2. I therefore humbly ask the court to grant the relief I seek.

Where would we be without the mental illness and violence allegations? These are always coincidental with a CCTV breakdown, and no one is ever hurt by me, but I am often seriously damaged in incidents upon which the Authorities refuse to comment.

I ask Geraint Davies and Barrister Sarah Branson BA to ensure I have the breathing aids I need in order to live. The most important, a dental device, denied to me by both UK public sector NHS and private dentistry, costs £65 (about $110 US).

I do not make the promises and threats of Broomleigh Housing Association, but I do keep my word. Please stop litigating against me.
